WORK HEALTH SAFETY MANAGEMENT SYSTEM TRAINING
WELCOME TO SJLM CONTRACTING
LEGISLATIVE OBLIGATIONS
“Worker”
- Workers are employees, contractors, subcontractors, outworkers, apprentices and trainees, work experience students, volunteers and PCBUs who are individuals if they perform work for the business.
- While at work, workers are required to take reasonable care for their own health and safety and that of others who may be affected by their actions or omissions.
- They must also cooperate with any reasonable instruction given by the PCBU and any reasonable policy or procedure of the PCBU to comply with the WHS Act and WHS Regulation.
LEGAL & OTHER REQUIREMENTS
The SJLM Contracting Work Health and Safety Management System (WHSMS) is developed to be compliant with the following Legal requirements:
- NSW Work Health Safety Act and Regulation
- Safe Work Australia / NSW WHS Codes of Practice (outlined on Legal Compliance Register)
- Industry & Australian Standards (outlined on Legal Compliance Register)
SJLM Contracting monitors the following to ensure all changes to current legal requirements have been identified and implemented into SJLM Contracting work practices.
- Updates provided by the Regulator (SafeWork NSW, SafeWork Australia & WorkSafe VIC ;
- Standards Watch (Intertek Inform, formally SAI Global);
- Fairwork Australia and
- My Business (formally Business Council NSW).
SJLM Contracting ensures all legal and other requirements are outlined on the Form 202 Legal and other requirements register.
Legal reference material can be located by HSE Systems Manager and/or site manager upon request.
ROLES AND RESPONSIBILITIES
Project Managers are responsible for:
- identifying hazards and assessing the risks associated with the work, and documenting the risk control measures to be taken
- managing compliance with OHS and workplace injury
- managing workers compensation legislation, regulations, standards and codes, Safe Work Method Statements and the Site Safety Rules
- assessing and monitoring the capability of service providers in the supply chain, and verifying that they meet OHS requirements
- providing service providers in the contract chain with the Site-specific OHS Management Plan and any updates; and managing OHS communication and consultation provisions in accordance with the regulatory and other requirements.
Works Supervisors and Team Leaders are responsible for the following:
- implementing the site-specific safety management plan
- displaying and making Site Safety Rules available to personnel on, and visitors to, the works site
- conducting site-specific induction, specific work activity safety training and refresher training
- making sure that before starting work on site all personnel attend suitable induction training courses
- managing workplace injury, illness and emergency management processes to suit procedures
- preparing, maintaining and making accessible the register of hazardous substances
- maintaining first aid stocks and providing first aid
- briefing team members on safe work procedures, if necessary
- consulting with the Project Manager (as necessary) if any potential hazards are detected which have not been planned for
- co-ordinating with other parties on site and restrict access to work areas, if needed
- issuing of protective clothing and equipment, if needed
- instructing workers on safe work procedures, if necessary
- checking that operators have certificates of competency
- planning traffic and plant movements, if necessary
- planning materials handling to avoid heavy manual lifting, where practicable; and keeping OHS records
Team members are responsible for the following:
- working in a safe manner without risk to themselves and others
- complying with the OHSMP including all Safe Work Method Statements
- reporting all incidents to the Works Supervisor
- reporting all injuries and illnesses to the designated First Aid Officer
- reporting any OHS hazards to the Works Supervisor
- providing suggestion, through agreed consultation methods, on how to improve OHS issues
- seeking assistance if unsure of OHS rules
- reporting any faulty tools or plant to the Works Supervisor
- complying with site safety rules
- correctly using all personal protective equipment; and
- complying with emergency and evacuation procedures.
ROLES AND RESPONSIBILITIES
The Safety advisor is responsible for the following:
Note: this is a role not a position; this role may be performed by the Works Supervisor
- assisting the Works Supervisor in the safe running of the site and ensuring that the site is organised so that work is carried out with minimal risks to workers, subcontractors and all others affected
- monitoring OHS performance, compliance and risk management on work sites. Report issues to Works Supervisor
- ensuring that all staff, subcontractors and visitors are properly inducted
- ensuring that staff and subcontractors are adequately trained for their allocated tasks
- ensuring adequacy of subcontractors SWMS and oversee any high-risk activities. Act as point of contact for subcontractors whose activities will impact on others operating on/using the site
- ensuring that all plant and equipment is appropriately inspected and maintained
- notifying the Works Supervisor of any incident or accident
- conducting or participate in incident/accident investigations
- ensuring that appropriate personal protective equipment is used
- promptly correcting any observed hazards or unsafe actions or condition
- ensuring that first aid and emergency procedures for the site are displayed on notice boards, established and maintained
- participating in site OHS audits
- assisting with weekly OHS site inspections
- ensuring that an up-to-date register is maintained for hazardous substances stored and used on site. Assess the risks of any hazardous substances proposed to be brought onto the site
- carrying out daily walkover of the site and ensure that all hazards and risks are being addressed.
Subcontractors are responsible for the following:
- operating under a system that identifies, assesses and controls risks. This may be their own or Our Organisation’ OHS Management Systems.
- ensuring that all their personnel are aware of their OHS responsibilities
- ensuring that all their personnel are properly inducted and trained in accordance with the OHS regulations and site rules
- ensuring that their plant and equipment are properly inspected and maintained
- notifying the Site supervisor of any safety or environmental incident such as oil spills, near misses, injuries
- when required, participating in incident investigations
- ensuring that their personnel hold all relevant tickets, licences and permits
- ensuring that appropriate SWMS are available on site.
RESPONSIBILITIES - WORKERS
The following key responsibilities apply to the role:
- Complying with the requirements of the SJLM Contracting WHSMS;
- Working in a safe manner without risk to themselves, others or the environment;
- Reporting all incidents or hazards to the Supervisor, Site Manager or WHS personnel;
- Providing suggestion, through agreed consultation methods, on how to improve WHS;
- Complying with site rules;
- Seeking assistance if unsure of WHS rules;
- Reporting any faulty tools or plant to the Supervisor or Site Manager;
- Correctly using all personal protective equipment;
- Complying with Emergency and Evacuation Procedures;
- Other WHS duties as directed by the Director, Site Manager, Supervisor or WHS personnel; and
- Any other requirements outlined in the SJLM Contracting WHSMS.
